Due to the message he was giving his listeners, the Unites States Congress enacted a law to shut John Brinkley down known as the Brinkley Act. The Brinkley Act states that it is illegal for a Unites States radio broadcast to be connected to a transmitter located in Mexico. Brinkley used a transmitter in Mexico because they were licensed there, and the U.S. could not threaten his broadcasting licenses.

Today, the Brinkley Act is usually not enforced, as many broadcasters in California and Texas are licensed in Mexico. However, the Act has started to be reinforced again lately.
